Sharing of Personal Information

Fold will not sell or rent your personal information to anyone, for any reason, at any time. However, we may share your personal information with our affiliates and business partners wherein such data sharing may assist the User in utilizing Fold Services. Additionally, you authorise Fold to share your personal information with:

  1. Members of the Fold group companies, to provide joint content, products, and services (such as registration, transactions and customer support), to help detect and prevent potentially illegal acts and violations of our policies, and to guide decisions about their products, services, and communications. Members of our group companies can use this information to send you marketing communications.
  2. Partner Financial Institutions, we may share your personal information with our partner financial institutions, and they may only use this information to market Fold-related products.
  3. Banking partners as required by credit card association rules for inclusion on their list of terminated merchants (in the event that you meet their criteria which includes having Fold close your Fold account due to your breach of our User Agreement).
  4. Any entities that we may propose to merge with or who may acquire us. You further agree and acknowledge that in the event we go through a business transition, such as a merger, acquisition by another organisation, or sale of all or a portion of our assets, your personal data might be among the assets transferred. In such a situation, the new entity which houses Fold Services shall follow this Privacy Policy with respect to your personal information. If your personal information could be used contrary to this policy, you will receive prior notice.
  5. Law enforcement, government officials, or other third parties pursuant to a subpoena/ summon, court order, or other legal process or requirement applicable to Fold or its affiliates; or to comply with law or debit/ credit card rules; or wherein Fold believes, that the disclosure of personal information is necessary to prevent physical harm or financial loss; or to report suspected illegal activity or to investigate violations of our User Agreement.
  6. Other unaffiliated third parties, for the following purposes:
    • Fraud Prevention and Risk Management: to help prevent fraud or assess and manage risk.
    • As part of our fraud prevention and risk management efforts, we also may share necessary account information in cases where Fold has placed a hold or other restriction on your account based on disputes, claims, chargebacks or other scenarios regarding the sale or purchase of goods. Also, as part of our fraud prevention and risk management efforts, we may share account information to enable them to operate their programs for evaluating buyers or sellers.
    • Customer Service: for customer service purposes, including to help service your accounts or resolve disputes (e.g., billing or transactional).
    • Shipping: in connection with shipping and related services for purchases made using Fold.
    • Legal Compliance: to help them comply with anti-money laundering and counter-terrorist financing verification requirements.
    • Service Providers: to enable service providers under contract with us to support our business operations, such as fraud prevention, bill collection, KYC document collection, marketing, customer service and technology services.
    • Other third parties with your consent or direction to do so.

Please note that third parties with whom we share your personal information will provide an equal level of protection as provided under this Privacy Policy and any applicable terms.
